The court of appeal was sentenced to 3 years and 3 months of imprisonment of the inhabitant of Kiev for stealing 11 rose bushes in the Park of Nivki with a total value of 258 USD.
This is stated in the judgment of the court, transmit Ukrainian news.
According to him, October 2, 2015 night the defendant, a native of Zhytomyr region, together with an accomplice dug in the Park Nivki 11 bushes of roses Floribunda cost of 23.5 hryvnia each, causing damage in the total amount of 258,5 USD. The offender was arrested at the scene by law enforcement officials.
In December 2016, the detainee was recognized by the Shevchenko district court of Kiev found guilty under part 3 of article 15, part 2 of article 185 (theft) of the Criminal code and sentenced to 4 years probation, including because of sincere repentance of the defendant.
The Prosecutor’s office filed a complaint against this verdict, because, in its opinion, the court of first instance did not consider that the defendant was previously convicted and is antisocial behavior.
The court of appeal agreed with the arguments of the prosecution and quashed the first instance verdict, as he felt insincere repentance of the offender, given his arrest at the scene.
“Thus, according to the panel of judges stated circumstances testify to the impossibility of correction of the accused and the prevention of new crimes without real serving of punishment in the form of imprisonment“, – said in the verdict.
The court decided to appoint the defendant the measure of restraint in the form of 3 years and 3 months imprisonment.
