Saint-Petersburg. March 12. INTERFAX – the Committee of property relations (KIO) of St. Petersburg said the wording of the regulations governing the transfer of Museum valuables Sampson Cathedral of the Russian Orthodox Church.
As reported “Interfax” in the Committee on Monday, in a previous Executive order stated that the contract for the transfer of Museum values is with the diocese, not the parish of St. Sampson Cathedral, which is the actual user object.
“The document we included the item on which the transfer shall be made after the relevant agreements to be concluded between the diocese and the Museum. But under Federal law such agreements are with an actual user, so they diocese concluded it could not be. We clarified the wording of this paragraph and provided that the transfer (values – if) is carried out after the contracts are concluded in accordance with Federal legislation”, – said the Agency interlocutor.
The Committee stressed that, in the opinion of the city authorities, because of incorrect wording was not complied internal procedure for the transfer of the Cathedral, but Federal law was not violated.
However, the interlocutor of Agency has added that FAS continues to discern a violation of the law “On protection of competition” in the transmission of the Cathedral Church, and the Committee intends this prosecution to challenge.
Informed in a press-service FAS has informed that the Committee of property relations changed the text of the order on the transfer of the Sampson Cathedral of the Russian Orthodox Church to avoid sanctions from the Department.
“KIO issued an order (on the transfer of the Cathedral – if), but a little bit wrong. During the consideration of the antitrust Committee has made the order changes and eliminated violations in connection disappears, the subject of the claim”, – said the interlocutor of the Agency following the session of Commission UFAS on Monday.
“We found a violation, but the injunction will not issue. To order the current revision, we have no complaints,” – said the press service.
As reported, the St. Petersburg office of the FAS Russia revealed a violation of the law when transferring Sampson Cathedral of the Russian Orthodox Church. We are talking about the violation of clause 4 part 1 article 17.1 of the law on competition protection in actions of Committee of property relations at the conclusion of the contract of uncompensated use of object of uninhabited Fund.
In accordance with the procedure established by this law, the KIO issued a decree about the use of the Cathedral of the diocese, but the transfer agreement was concluded with another legal entity, namely the parish of St. Sampson Cathedral. The parish is solely responsible for its obligations, however, not liable for the obligations of the diocese, and the diocese is not liable for the obligations of the parish.
Sampsonievsky Cathedral, which was part of the GMP St Isaac’s Cathedral, was transferred to the Church in February 2017.
