Concern “Kalashnikov” filed in the arbitration court of the Udmurt Republic the claim to the French company Cybergun S. A., which produces replica weapons, the materials in the files of the court.
The Russian company in its lawsuit demands to recognize the right to use the designations “Kalashnikov” and “Kalashnikov” as a means of individualization, namely, component parts of trade names and trademarks, and the right to use the name of the designer Mikhail Kalashnikov in economic activities. The defendant’s actions impeding the exercise of the rights of the plaintiff, “Kalashnikov” asks to recognise as illegal the ruling of the court.
The lawsuit was filed in may, the court took it into consideration. The next court hearing will be held in December in Izhevsk.
The press service of “Kalashnikov” was unable to immediately comment on the RBC filing.
Cybergun SA develops and sells owolosenie weapons, which are exact copies of products of famous manufacturers of firearms. In particular, the company offers copies of the Kalashnikov, Kalashnikov machine gun and sniper rifle Kalashnikov, shows the site of the company. Cybergun is based in France and is traded on the Paris stock exchange.
“Kalashnikov” — the largest Russian manufacturer of automatic combat and sniper weapons, guided artillery shells, precision-guided weapons. The group manufactures products under three brands: “Kalashnikov” (fighting and civil weapon), “Baikal” (hunting and civil weapon), and “Izhmash” (the sports weapon). “Kalashnikov” is under the control of the state Corporation “rostec”.
In 2014, the concern “Kalashnikov” filed a lawsuit against the company ZAO “M. T. Kalashnikov”, owned by the daughter and grandson of Mikhail Kalashnikov. The reason for going to court was the company’s use of the brand with the three-dimensional image of the machine and the verbal element of the AK-47. “Kalashnikov” was required to terminate the legal protection of a trademark in Russia. In April, the intellectual property rights court fully satisfied the claim of the concern.
