A group of deputies of the State Duma announced his intention to check the validity of the demolition without a court decision. Thus they question including the validity of the decision of the Moscow city hall for the demolition of several buildings at the beginning of this year, according to the newspaper “Kommersant”.
To check the conformity with the Constitution part 4 of article 222 of the Civil code (GK) the deputies decided Vladimir Rodin (CPRF), Alexander Ageev (“Fair Russia”) and Vitaly Zolochiv (LDPR). According to the homeland, the amendment to the Ledger that allows you to demolish the unauthorized construction within the simplified procedure was adopted following the reunification of Crimea with Russia. The deputies voted for it because it was necessary to solve the issue of unauthorized construction on the Peninsula. The authorities of Moscow, in his opinion, took advantage of the new norm and violated by their actions the property right of owners of retail outlets, which were demolished in the night of 9 February and after.
Ageev in turn indicates that the state Duma adopted the bill did not originally provide for the right to “demolish the property with property rights.” He believes that the authorities should compensate owners of demolished buildings on the erection of new buildings.
