The Ministry proposes to tighten the licensing conditions for tour operators

The Ministry of economic development and trade of Ukraine proposes to strengthen the responsibility of tour operators before consumers of tourist services and to oblige them to provide the minimum amount of financial guarantee for the entire term of the license.

The relevant draft resolution of the Cabinet of Ministers published on the official website of the Ministry.

The tourist did not receive financial support from the tour operator in case of insolvency of the latter, or due to violation of the process of recognition of its bankruptcy.

According to the Ministry, as of Oct-2018 from 2.7 thousand licensed tour operators only 578 have a valid financial assurance — the guarantee of a Bank or other financial institution.

“Therefore, there is need to install in the license conditions clear requirements to comply with the tour operators for the duration of the license in the minimum amount of financial security and renewal of the guarantee amount in case of payment”, — is spoken in the explanatory note to the document.

In particular, market participants want to be required to restore the amount of financial guarantees within one working day in case of warranty payments to customers.

It is also proposed to oblige tour operators to place on their websites information about the number of prisoners with tourists treaties, information about the travel agents, the tour operator, as well as information about the existence of finobespecheniya.

In addition, the Ministry plans to require operators to publish information on flight delays for 4 hours or more, as well as to inform the licensing authority.

Moreover, tour operators should create the necessary conditions for access to their offices for persons with disabilities and other disabled groups. The operator must inform such clients about the necessary for them into the tourist infrastructure in a package before selling the product.

The draft resolution also establishes requirements for the state tour operator. So, at least 30% of employees will need to have three or more years of work experience in tourism or relevant higher education.

The draft decree defines the notion of “impeccable business reputation of the head of the tour operator”. Is a collection of confirmed information on individuals, which allows to make a conclusion about conformity of its activity to legislation requirements, appropriate professional, managerial skills and absence of criminal record for crimes in the sphere of economic activity, not removed or not extinguished in the order established by law. The presence of impeccable reputation is one of the conditions of obtaining a license of the tour operator.

Recall that the total revenue of the Ukrainian operators in the past year exceeded 13 billion, have benefited from their services of 2.56 million people.
