Parents gain the rights to the dead child’s Facebook

Germany’s highest court has ruled that the parents of a dead daughter, the rights to your Facebook account, under the law of succession.

The Federal court of justice (BGH) said, the online data will be treated in the same way as private diaries or letters and handed them to the heirs.

The case concerns the parents of a 15-year-old girl, killed by a train in 2012.

They were looking for as you try to access your Facebook account, in order to determine whether the death was a suicide.

Apart from emotional closure, even the parents wanted to know whether the driver was entitled to the compensation, as would be the case, in the case of suicide.

Facebook contacts had no access to the account after her daughter’s death, citing privacy concerns about the girls.

Under its current policy, the company is a part of only allowed the relatives of the dead wise access to the account, which will allow you to change the page into an online memorial, or to delete it.

A lower German court supported the parents in the year 2015, supports the assertion that Facebook data of inheritance law as the equivalent of private correspondence.

But in the year 2017, a court of appeal supports Facebook and was met with the decision on the basis of the assumption that each contract between the girls and the company ended with her death and could not pass it on to the parents.

The case went to the Supreme court, and their parents have now reportedly taken over the account.

Judge Ulrich Hermann said it was usual to hand over the private diaries and correspondence to the legal heirs after the death, and there was no reason for the treatment of digital data differently.

In addition, the court added, to know that the parents had a right to be who your child is a minor, had been talking to online.
