In accordance with the so-called “law Savchenko” the term of detention, the court read out the sentence according to the formula “day in jail, two days in jail.”
The Kiev district court of Kharkiv has convicted the organizer and coordinator of the organization “South-East” Yuri Apukhtina of organizing mass riots, accompanied by pogroms and public appeals to violent change of the constitutional system of Ukraine and the seizure of state power.
“Finally Apuhtina Yuri Mikhailovich assign a sentence of 6 years imprisonment”, – is spoken in the sentence, announced on Tuesday a judge Yana Gubskaya.
In accordance with the so-called “law Savchenko” the length of stay in jail (30 April – 7 may 2014 and from 19 December 2014 to present) the court read the term of punishment according to the “day in jail, two days in jail.”
The court also extended the arrest of Yu Apuhtina before the sentence in force, but not more than 60 days (July 22).
The verdict is not yet in force. It can be appealed.
“Another decision I didn’t expect. I thought I was innocent and now think,” – said Yuri Apukhtin after the verdict.
His lawyer Dmitry Tikhonenkov said he believes the verdict is unreasonable, so he will appeal.
The representative of state charge he stated that the decision whether to submit an appeal will be taken after studying the text of the decision.
“I think that in General the court made an informed and reasoned decision. Decision on appeal appeal to us will be made after a detailed study of the text of the decision”, – said M. Brain.
As reported, Yulia Apukhtina charged with organizing mass riots, accompanied by pogroms (part 1 of article 294 of the Criminal code) and public calls to violent change of the constitutional system of Ukraine and the seizure of state power (part 3 of article 109 of the Criminal code of Ukraine).
During a pretrial investigation it is established that Yuri Apukhtin was the organizer of mass riots in April 2014 the building of the Kharkiv regional state administration. He has repeatedly and publicly called for change of the constitutional system, the non-recognition of the existing state power, the establishment of a “Kharkiv people’s Republic” and so-called “Constitution HNR”.
In January 2015, the indictment against Yulia Apukhtina was sent to the court.
Kyiv district court of Kharkiv has returned an indictment to the Prosecutor to address the shortcomings. Representatives of the public prosecution claimed that the act is fully consistent with the criminal procedure law, and appealed the decision of the court of first instance in the court of appeal.
March 19, 2015 court of Appeals of the Kharkiv region returned the indictment against Yulia Apukhtina for consideration in essence in court of first instance.
The state Prosecutor M. Brain during debate asked court to appoint Y. Apuhtina the maximum punishment provided for the incriminated articles, in the form of 8 years of imprisonment.
The accused and the defense claimed that the accusations were unfounded and asked the court to acquit the defendant.
