The Supreme court of Russia upheld the decision of the lower court to dismiss the lawsuit KSHP (collective agricultural enterprise) “Khimki” for the recovery of land, where is the Central office of a Russian subsidiary of IKEA, thereby satisfying the complaint of the Swedish company. “Judicial Board on economic disputes upheld the court acts to dismiss the claim of the PSC “Khimki” OOO “IKEA khanim LTD for the recovery of land from illegal possession and the demolition of illegally erected buildings on it, including two 15-storey buildings of the business Park “Khimki” — said the Agency interlocutor.
IKEA filed a complaint with the Supreme court on 21 January 2016. The company demanded to cancel the decision of Arbitration court of Moscow district for reconsideration and leave in force the decision of Arbitration court of the Moscow region and the Tenth arbitration appeal court, which dismissed the claim of the KSHP “Khimki” to IKEA.
In late April, the Supreme court has accepted for consideration the complaint of the Swedish company. “We are pleased with the court’s decision and hope that the highest court will put finally an end to the numerous attempts of raider seizure of the ownership of IKEA,” — said the lawyer of the company Ivan Veselov. He noted that in 2015 the sun has passed for consideration to only 2% of complaints, however, 86% of them were satisfied.
In the framework of the dispute IKEA with KSHP “Khimki” on the plot of land on the Leningradskoe highway, which lasts for more than 20 years, two criminal cases of fraud in the company’s acquisition of the land and about swindle in especially large size.
