The Moscow Prosecutor’s office again quashed the decision on excitation of criminal case on hooliganism after “racing” the car Gelandewagen son of Vice-President of LUKOIL. This was reported on the website of the Department. As noted in the message, criminal case under article 213 of the criminal code (hooliganism) was opened illegally, as the editors of this article does not allow to evaluate the actions of participants in the events as a criminal offense.
However, the Prosecutor stated that the Ministry sees in the actions of participants in the events the signs of a crime under article 319 of the criminal code (insulting the authorities). As the investigation of the criminal case under this article is within the competence of the CCJ, the Prosecutor’s office sent check materials to the Moscow Department of the TFR for the adoption of procedural decisions, the report said.
The article “hooliganism” carries a maximum sentence of five years imprisonment, and under article 319 of the criminal code (insulting the authorities) — one year of correctional labor.
22 may Gelandewagen Mercedes with no license plates, owned by the son of the Vice-President of the LUKOIL oil company Ruslan Shamsuarov, for a long time walked away from the police, violating traffic rules. Last Saturday was arrested Shamsuarov, the court sentenced him to 15 days of administrative arrest for disobeying the police. Three of his friends who were with him in the car, also were sent under arrest.
On the evening of 28 may, the Ministry of internal Affairs informed that in fact the race of the criminal case on hooliganism. It happened for the second time — originally the case was opened after the incident, however, then the Moscow Prosecutor’s office cancelled the decision and sent the materials for additional verification.
