Russia and Ukraine “took a pause” in the exchange of Russians Alexander Alexandrov Evgeny Erofeev, which Kiev calls “the GRU soldiers”, the Ukrainian servicewoman Nadezhda Savchenko. In an interview with “Radio Liberty” the lawyer said Russians Oksana Sokolovsky.
“There were some agreements [on the exchange], which had not been completed. It is possible that the parties are awaiting the entry into force of the sentence Erofeev and gave. But now I come to the conclusion that the exchange may not take place”, — said Sokolowski.
According to the lawyer, Moscow and Kiev earlier agreed that, in particular, involves the exchange of prisoners through the procedure of pardon by two presidents. But such acts “was not a one or the other side,” she said. “Now we doubt that can be made agreement on the transfer of sentenced persons to their homeland, since this requires that Ukraine acknowledged the verdict Savchenko, a Russian sentence Erofeev and gave. However, it is clear that neither the one nor the other side of this will not do” — said Sokolowski. According to her, she had information that the exchange had to take place before the may holidays.
And Aleksandrov, and Erofeev previously refused to appeal the sentence of the Ukrainian court, which sentenced them to 14 years imprisonment. Sokolovsky has noticed that in case of failure of negotiations on the exchange of her client “will be denied the right of further appeal, including in the European court of human rights” and be forced to serve their sentences in Ukraine. “Because of this [exchange] doesn’t happen, I do not rule out filing an appeal on the verdict of the Goloseevsky district court of Kiev, which comes into force on may 23,” she said.
At the same time, the lawyer Savchenko mark Feigin said “UKRINFORM” that he had no information about the breakdown of negotiations. “I want to emphasize, in this situation, I do fear to comment on the political component. At the highest level, fundamentally the decision is made. Still the question is how to translate this in the strictly legal plane,” he said.
As previously reported by the sources of RBC, the exchange Savchenko, Alexandrov Yerofeyev must happen before the end of may. They will need to transfer synchronously, after the entry of the verdicts in force.
The sentence of Nadezhda Savchenko on March 22, were made in Donetsk city court (Rostov region). He came to the conclusion that in the summer of 2014, Savchenko fought in the Ukrainian battalion “Aydar” in Luhansk region and brought artillery fire on a film crew of VGTRK. She was sentenced to 22 years in prison. The verdict against her is already in force.
The decision by Alexandrov and Erofeev was issued on 18 APR. They were convicted for terrorism and participation in hostilities in the Donbass. Under Ukrainian law, the sentence shall enter into force 30 days after its adoption.
