Prosecutors challenge “ban collectors” in Kemerovo

The Prosecutor’s office of the Kemerovo region has made a protest to the law on collection activities, adopted in the region, reports “RIA Novosti” with reference to the representative of Department Elena, Tushkevich.

“The subject of legal regulation of this law are civil legal relations, and they are in accordance with the 71st article of the Constitution of the Russian Federation are within the exclusive competence of the Russian Federation, that is, such laws must pass a Federal legislator”, she explained.

The Prosecutor’s office opposes the illegal actions of collectors, but to limit their rights in this way is illegal, he added Tushkevich. “We need to do it the Federal legislator”, she explained.

The Council of people’s deputies of the Kemerovo region creates a working group to consider the claims of the Prosecutor’s office, according to local portal ngs42.ru with reference to the head of Committee concerning a state system and local self-government Alexey Sinitsyn.

However, as emphasized in the National Association of professional collection agencies (NAPCA) , the law prohibits only “collection activities (activities to repay debt) that violate the rights and lawful interests of individuals.” Collectors complained that people misunderstood the essence of the law and began to refuse to interact with them, on the grounds that the activities of collectors is prohibited. Another problem called collectors increased bureaucratic pressure. They called on the Prosecutor General to repeal the law.
