In RBC were amendments to the bill “About state regulation of activity on transportation of passengers and Luggage by automobile taxi in the Russian Federation…”, developed by the Ministry of transport. The bill was in 2014 adopted in first reading. Amendments to the second reading of the Ministry of transport started to cook more in 2015, has already released several versions. A few current market participants in a conversation with RBC’s called “the toughest”. Proposals of the Ministry of transport is fraught with additional costs for passengers, online aggregators and the taxi drivers.
News for passengers
First and foremost amendment, it follows that online services will not be able to set tariffs for transportation without the consent of the carriers. Now aggregators to independently regulate tariffs. But carriers are constantly complaining that they can’t compete with their “low” prices.
Employee the largest online aggregator is a requirement of the Ministry of transport is unclear: the aggregator is a monopoly, the carriers have the choice to work with him on set rates, or not work, why does it need to agree? “If the carrier would seem that his services to the airport are 2000 rubles, for which buyers will not go, will lose profits and aggregators, and the carrier itself,” he warns. The need to harmonize tariffs with the carriers will “not in favor of customers”, agrees the employee of a different aggregator.
For news aggregators
Agents on the transport, including online aggregators should carefully select contractors — taxi fleets and private drivers, says the transport Ministry. He suggested that “Yandex.Taxi”, Gett, Uber checked they have the licence for transportation of passengers (and their Luggage) and the documents on the right to entrepreneurial activity. Now the law does not require it.
Additional responsibilities will lead to the fact that aggregators will “spend the lion’s share of time checking permissions”, — warns the employee of one of the major online taxi services. In his opinion, this will lead to increased costs and, as a result, growth of prices for services. However, representatives of big services are insisting that now only work with legitimate partners (in Moscow there is even an agreement with the Department of transport).
The amendments introduce also the responsibility of the aggregator to passengers for the quality of services. The interlocutors RBC in several major online taxi aggregators resemble that are the intermediaries between passengers and carriers, and cannot bear such responsibility. At Uber, “Yandex.Taxi” and Gett the corresponding item is in agreement with the users.
News for taxi drivers
The amendments affect themselves and taxi drivers. The transport Ministry proposes to limit the maximum number in Russia issued permission for carting: and if the number of applicants will be more auctions.
Limiting the number of permits “sensible idea”, said General Director of “Eurotransservice” and the Chairman of the Committee of the Moscow chamber of Commerce and industry on taxi Bogdan Konoshenko. However, he believes that it is necessary at the same time be allowed to sell license, rent and bequeath. Such rules, for example, are in new York. This will help to protect the market against unfair competition, considers Konoshenko.
The amendments provide for the introduction of a single exterior colors for all licensed taxi drivers (in case of establishment of such requirements of local laws) and registration plate on the car. Now each region is addressing the issue independently (for example, in Moscow, from July 2013 the new licenses will be issued only to owners of cars painted in yellow or pasted special yellow film).
Restrictions on the issuance of permits and requirements for the unification of taxis may lead to restriction of competition, says the interlocutor of RBC in a large haulage company. Carriers will need time to get a replacement license plate and reissue permits and, as a result, may temporarily reduce the number of working drivers, he warns.
News from members
On April 25 appointed a conciliation meeting in the government on the draft amendments, which should be attended by representatives of the Ministry of transport, Ministry of economic development, Ministry of justice, the Moscow government and the Troika the largest online aggregator “Yandex.Taxi”, Gett, Uber, has informed RBC a source in one of the major services of taxi aggregators. Initially the meeting was to be held on 15 April (a copy of the invitation to the meeting, signed by the Director of the Department of industry and infrastructure of the government of Russia Alexei Uvarov, is at the disposal of RBC).
One of the authors of the draft law “On taxi”, the first Deputy Chairman of state Duma Committee on constitutional legislation and state construction Vyacheslav Lysakov in a conversation with RBC was named the project of the Ministry of transport of “raw”. “He don’t made, so I don’t see much reason to comment on this paper”, — told RBC, expressing the hope that the introduction of a government project “quite different”. “We [at the Committee] have a fundamental disagreement with a number of rules that are in this paper”, — said the Deputy. Lysakov believes that it is necessary to distinguish between the liability of carriers and aggregators: “Everyone must answer for himself dispatch service through which a customer orders a taxi, ensures that the transportation to be provided by the driver license. And the driver is carrying out the order, is responsible for the safety and quality of services. It would be strange if the Manager answered in the case of an accident involving the taxi driver,” he says. Lysakov proposes to introduce in the bill the definition of “dispatching service”, that is, to legally form a business definition of online aggregators (member prepares his version of the amendments).
The representative of the Ministry of transport was limited to a review that will consider all proposals and then the government will take a decision. Representatives Gett, “Yandex.Taxi” and Uber refused to discuss the project.
